How many porta potties does OSHA require on a construction site?

OSHA 29 CFR 1926.51(c) Table D-1 requires 1 toilet for a crew of 20 or fewer workers. A crew of 20 to 199 needs 1 toilet seat and 1 urinal per 40 workers, and a crew of 200 or more needs 1 seat and 1 urinal per 50 workers. A standard PolyJohn PJN3 has 1 seat and 1 urinal.

Mobile crews. Section 1926.51(c)(4) says the toilet rule does not apply to mobile crews that have transportation readily available to nearby toilet facilities. A Loop 20 striping crew that moves every hour is different from a framing crew on one lot all week.
Hand washing

Does OSHA require a hand-wash station on a jobsite?

OSHA 1926.51(f) requires adequate washing facilities when workers apply paint, coatings, herbicides or insecticides, or work with other contaminants that may be harmful. The washing facilities must be close to the work and equipped so workers can remove those substances. A 2-sink hand-wash station with soap and towels covers most Laredo crews.

When it is required

Painting, stucco and drywall finishing, roofing with coatings, weed and pest spraying, concrete work with harmful additives — any job where a worker would carry a contaminant to lunch.

Where it goes

Next to the toilet and near where crews eat. On a warehouse slab off Mines Road, that usually means beside the porta potty at the edge of the laydown yard.

Farms & ranches

What are the OSHA porta potty rules for farm and ranch crews?

OSHA 29 CFR 1928.110 covers agricultural employers with 11 or more employees doing hand labor in the field. The rule requires 1 toilet and 1 hand-washing facility for every 20 workers, located within a quarter-mile walk of the crew, plus drinking water. Fieldwork of 3 hours or less a day, counting travel time, is excused.

Webb County is ranch and brush country, and crews move. That is why the towable unit — a standard porta potty on a single-axle trailer — exists. It follows a fencing or brush-clearing crew from one pasture to the next, staying inside that quarter-mile limit.

Warehouses & plants

Which OSHA rule covers porta potties at a warehouse or truck yard?

Permanent workplaces such as warehouses, cross-dock yards and plants fall under OSHA's general industry sanitation standard, 29 CFR 1910.141, not the construction rule. That standard counts toilets by the number of employees, starting at 1 toilet for 1 to 15 workers. Portable units usually supplement building restrooms during remodels, peak season or yard expansions.

Laredo's logistics economy runs on yards: the World Trade Bridge moves about 10,000 northbound trucks a day, and the warehouses along Mines Road (FM 1472) and in Killam Industrial Park house the drivers and dock crews that move that freight. When a building restroom is out of service or the yard is a long walk from the dock, a portable unit fills the gap.

Accessibility

When is a wheelchair-accessible porta potty required?

At public sites, the 2010 ADA Standards §213.2 require at least 5% of portable toilets in each cluster to be accessible, with a minimum of 1. Section 203.2 exempts portable toilets used only by construction workers on a construction site. Our PolyJohn Comfort XL is wheelchair-accessible, with a 32-inch door frame and a roll-in floor.

"Accessible" vs "compliant": the words matter

One caller asked, "Does it have to be ADA, or just handicap?" Fair question. We describe the PolyJohn Comfort XL as wheelchair-accessible: 62 × 62 inches outside, a 32 × 74-inch door frame, no step at the sill and more than 16 square feet inside.

Whether a site meets the ADA depends on the whole setup — ground, path, placement and signage — not just the unit. If an inspector or permit office is involved, ask what they need before the event. Unit details are on the wheelchair-accessible porta potty page.

Texas law

What does Texas law say about porta potties at large events?

The Texas Mass Gatherings Act, Health and Safety Code Chapter 751, covers events outside city limits with more than 2,500 people, or more than 500 if at least 51% are under 21 and alcohol is present, lasting over 5 hours or overnight. Promoters need a county judge permit, filed at least 45 days ahead, describing sanitation.

Chapter 751 in practice

  • Where: outside the limits of a city. A ranch venue past the Laredo city line can qualify; a backyard in Del Mar Hills does not.
  • Size and time: more than 2,500 people (or 500 in the under-21-with-alcohol case), for more than 5 continuous hours or any time between 10 p.m. and 4 a.m.
  • Who issues it: the county judge — in Webb County, the Webb County Judge.
  • Deadline: at least 45 days before the event.
  • Restrooms: the statute asks for your sanitation plan; counties set the numbers. Hidalgo County's 2016 policy caps it at 50 people per toilet seat.

TCEQ: who may haul the waste

In Texas, anyone who transports chemical toilet waste must register with the Texas Commission on Environmental Quality as a sludge transporter. That covers pumping porta potties, RV holding tanks and restroom trailers.

If someone offers to pump your camper or a privately owned restroom trailer, ask for the registration before the hose comes out. You can look up the program on the TCEQ sludge transporter registration page.

City of Laredo

Do I need a City of Laredo permit to put a porta potty in the street?

Work in the City of Laredo right-of-way needs a right-of-way permit from Building Development Services. The city lists the fee at 50 dollars for residential and 250 dollars and up for commercial, and the permit must be obtained by a registered contractor. Jason Rental Works places units on private property, inside your property line.

The city's permit page lists driveways as the common use, and it does not say whether a portable toilet at the curb counts. Rather than guess, we keep units off the street, the sidewalk and the strip between them. If the street really is the only spot — a downtown storefront remodel, for example — call Building Development Services before you book.

Event permits inside Laredo. We could not confirm the city's current special event permit process. Call City of Laredo 311 to confirm what your event needs before you finalize restrooms, and ask whether a site plan should show them.

What is the difference between the legal minimum and what we recommend?

The legal minimum is the floor an inspector checks; our recommendation is what keeps a crew working in 100°F heat. OSHA's Table D-1 says 1 unit for 20 workers and does not set a weekly cleaning schedule. We recommend weekly service year-round and 2 visits a week from May to September for crews of 8 or more.

Laredo averages 100.8°F in July, with about 74 days a year at or above 100°F. Odor and water use climb fast in that heat, and a full tank is a unit nobody wants to use. What records should I keep to show my site is in compliance?

Keep 3 records: the rental invoice showing unit count and type, the dated service ticket inside each unit door, and your peak crew count. Every Jason Rental Works jobsite unit gets a dated service ticket at each weekly visit, so a safety walk-through can see the last service date at a glance.

  • Update the unit count when the crew grows. A slab crew of 12 can be a crew of 50 once framing and MEP trades arrive.
  • Ask for an extra service visit before an inspection or a buyer walk-through.
  • Keep the on-site contact's name and number on the order so drivers can reach a person on site.

How many porta potties does OSHA require for 25 workers?
OSHA 29 CFR 1926.51(c) Table D-1 requires 1 toilet seat and 1 urinal per 40 workers once a crew passes 20. For 25 workers that means 1 seat and 1 urinal. A standard PolyJohn PJN3 has both, so 1 unit meets the minimum. In Laredo summer heat, we recommend 2 service visits a week for that crew.
Does OSHA say how often a jobsite porta potty must be cleaned?
OSHA's construction standard does not set a pumping schedule in days. It requires toilets to be provided and kept sanitary. Our standard is 1 service visit per week, included in the 28-day rate, and 2 visits a week from May through September for crews of 8 or more.
